BE MOGUL®TERMS AND CONDITIONS

These Terms and Conditions ("Agreement") govern your access to and use of all products, services, memberships, software, applications, AI systems, educational content, websites, communities, digital downloads, subscriptions, affiliate programs, coaching programs, and technology offered by BE MOGUL®, LLC, its subsidiaries, affiliates, licensors, and future brands.
By purchasing, accessing, using, or participating in any BE MOGUL® product or service, you acknowledge that you have read, understood, and agree to be legally bound by these Terms.

• Live Events
• Workshops
• Challenges
• Digital Downloads
• Templates
• Prompt Libraries
• AI Agents
• AI Assistants
• Custom GPTs
• AI Strategists
• AI Coaches
• AI Employees
• Business Systems
• Software Applications
• Mobile Applications
• Browser Applications
• Chrome Extensions
• Automation Systems
• Funnels
• Books
• Journals
• Merchandise
• Subscription Services
• Consulting
• Done-For-You Services
• Group Coaching
• Private Coaching
• Licensing Programs
• Affiliate Programs
• Digital Products
• Physical Products
This Agreement automatically extends to all future products, services, technologies, software, and platforms released by BE MOGUL®.

3. PLATFORMS COVERED

These Terms govern all access through platforms including but not limited to:
• BE MOGUL® websites
• Shopify Stores
• Beacons
• Skool Communities
• Facebook Groups
• Facebook Pages
• Instagram
• TikTok
• LinkedIn
• YouTube
• Discord
• Circle Communities
• Vimeo
• Email Lists
• SMS Lists
• Customer Portals
• AI Chat Interfaces
• Custom GPTs
• Mobile Apps
• Desktop Apps
and all future community hubs, websites, software, social media pages, digital properties, or communication channels operated by BE MOGUL®.

4. MEMBERSHIP ACCESS

Every product includes access only to the specific materials purchased.

Purchasing one product does not grant access to every BE MOGUL® product.

Access levels vary by purchase.
Separate memberships require separate enrollment.
Additional upgrades may be required for premium content.
BE MOGUL® reserves the right to add, remove, reorganize, rename, relocate, or improve content at any time.

5. TIER 3 SAAS SUBSCRIPTION POLICY

Tier 3 Members receive access to BE MOGUL® SaaS Studio and white-label technology while their subscription remains active.

If a Tier 3 SaaS Control Subscription remains unpaid for three (3) consecutive months:
• Studio access will be suspended.
• White-label software licenses may be revoked.
• Connected applications may be disconnected.
• Stored content may be permanently removed.
• The Studio account, projects, databases, custom branding, connected automations, and associated files may be permanently deleted without further notice.
BE MOGUL® is under no obligation to recover deleted data after account termination.

6. INTELLECTUAL PROPERTY

All content is protected by United States and international copyright, trademark, patent, trade secret, and intellectual property laws.
This includes but is not limited to:
Training
Videos
Graphics
Branding
Logos
Course Material
Frameworks
Presentations
PDFs
Prompt Libraries
Prompt Systems
AI Agents
Custom GPTs
AI Employees
AI Coaches
AI Strategists
Automation Systems
Workflows
Templates
Software
Source Code
Designs
Images
Icons
Marketing Assets
Email Campaigns
Sales Funnels
Business Processes
Certification Materials
Assessment Systems
Downloads
Books
Audio
Music
Videos
Studio Software
White Label Systems
Business Models
Membership Structures
Product Names
Brand Names
Trademarks
Future inventions and proprietary technology.
Nothing in this Agreement transfers ownership of any intellectual property.

7. CUSTOM GPT, AI SYSTEMS & AGENT USAGE

Access to BE MOGUL® AI systems is licensed—not sold.
Users may not:
Copy AI instructions
Duplicate prompts
Extract system prompts
Reverse engineer Custom GPTs
Rebuild proprietary AI systems
Sell copies
Create competing products using proprietary BE MOGUL® prompts
Share private GPT links
Share protected prompts
Redistribute AI workflows
License AI systems to others without written permission.
Violation may result in:
Immediate termination
Removal of access
Affiliate termination
Legal action
DMCA enforcement
Permanent account suspension

8. WHITE LABEL STUDIO RIGHTS

Tier 3 members receive a limited software license.
Ownership of the underlying platform always remains with BE MOGUL®.
White-label rights do not transfer ownership of:
Software
Code
Infrastructure
Servers
AI models
Brand assets
Internal automations
Frameworks
Studio architecture
Members own the original content they create within their Studio unless otherwise stated.

9. ACCEPTABLE USE

Users agree not to:
Share passwords
Share paid content
Copy courses
Record proprietary training for resale
Resell protected materials
Upload malicious software
Hack systems
Disrupt services
Misrepresent affiliation
Use trademarks without permission
Create counterfeit products
Violate applicable laws.
BE MOGUL® reserves the right to suspend access immediately.

10. AFFILIATE PROGRAM

Unless otherwise stated for a specific promotion or written agreement:
Current and future BE MOGUL® products provide affiliates with no less than fifty percent (50%) commission on qualifying sales generated through their approved affiliate links.
Some products may offer higher commission percentages through promotional campaigns, licensing agreements, or special programs.
Affiliate eligibility, approval, commission schedules, payout minimums, promotional rules, and exclusions may vary by product.
Affiliates must:
Use approved marketing materials when required.
Represent products honestly.
Avoid false income claims.
Avoid misleading advertising.
Use only authorized affiliate links.
Violation may result in:
Affiliate removal
Commission forfeiture
Account termination
Legal action

11. PRICING

Prices may change at any time.
Discounts, bonuses, promotional pricing, scholarships, payment plans, and coupons may be modified or discontinued without notice.
Existing purchases remain governed by the terms in effect at the time of purchase unless otherwise stated.

12. REFUND POLICY

Unless expressly stated otherwise in writing:
All sales are final.
No refunds.
No exchanges.
No transfers.
No chargebacks.
Digital products become non-refundable once access has been granted.
Subscription services remain active until canceled according to the applicable billing terms.

13. COMMUNITY STANDARDS

Participation in any BE MOGUL® community—including Skool groups, Facebook groups, Discord servers, community hubs, live chats, coaching calls, and future community platforms—requires respectful and professional conduct.
Harassment, hate speech, spam, solicitation, disruptive behavior, unauthorized promotion, or attempts to recruit members into competing programs may result in immediate removal without refund.

14. ACCOUNT SECURITY

Users are responsible for maintaining the confidentiality of their login credentials.
BE MOGUL® is not responsible for unauthorized access resulting from shared passwords, weak security practices, or user negligence.

15. RESULTS DISCLAIMER

Individual results vary.
No guarantees are made regarding income, business growth, clients, funding, sales, or financial success.
Success depends on numerous factors, including each user's effort, experience, skills, implementation, market conditions, and business decisions.
Testimonials and examples are illustrative and are not guarantees of future performance.

16. LIMITATION OF LIABILITY

To the fullest extent permitted by law, BE MOGUL®, Supreme Consulting and Solutions LLC, its owners, officers, employees, contractors, affiliates, licensors, and partners shall not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages arising from the use of its products or services.

17. MODIFICATIONSBE MOGUL® reserves the right to modify these Terms at any time.
Updated Terms become effective immediately upon publication unless otherwise stated.
Continued use of any BE MOGUL® product constitutes acceptance of the revised Terms.

18. GOVERNING LAW

These Terms shall be governed by and interpreted under the laws of the State of North Carolina, without regard to conflict of law principles.

Any legal action arising under these Terms shall be brought in a court of competent jurisdiction located in North Carolina unless otherwise required by applicable law.

20. ACCEPTANCE OF TERMS

By accessing, purchasing, subscribing to, downloading, registering for, or participating in any BE MOGUL® website, application, community, course, software platform, AI system, Custom GPT, SaaS Studio, coaching program, affiliate program, event, social media community, digital product, physical product, or future offering, you acknowledge that you have read, understood, and agree to be legally bound by these Terms and Conditions.

21. COPYRIGHT, DMCA & INTELLECTUAL PROPERTY ENFORCEMENTBE MOGUL® aggressively protects its intellectual property.

All content created, published, distributed, or licensed by BE MOGUL® is protected by United States copyright laws and international intellectual property laws. Unauthorized copying, recording, downloading, uploading, reproducing, distributing, teaching, reselling, translating, repackaging, reverse engineering, or creating derivative works from any BE MOGUL® materials is strictly prohibited.

BE MOGUL® reserves the right to pursue all available legal remedies, including DMCA takedown notices, cease-and-desist letters, account termination, civil litigation, and recovery of attorney's fees where permitted by law.

22. TRADEMARKSBE MOGUL® is a registered trademark owned by Supreme Consulting and Solutions LLC.
Nothing contained within any product, course, website, software platform, community, or marketing material grants permission to use the BE MOGUL® name, logo, branding, trade dress, slogans, or other brand identifiers without prior written permission.

Users may not:

• Create confusingly similar brands
  
• Register similar domain names
  
• Use BE MOGUL® logos without authorization
  
• Represent themselves as official BE MOGUL® representatives without written approval
  
• Modify or recreate official branding for commercial purposes
  

23. AI ACCEPTABLE USE POLICY

Users agree to use all BE MOGUL® AI products responsibly.
Users may not:

• Attempt to extract hidden system prompts
  
• Reverse engineer AI assistants
  
• Clone Custom GPTs
  
• Recreate proprietary AI agents
  
• Sell prompt libraries
  
• Share private GPT links
  
• Build competing AI products using BE MOGUL® proprietary systems
  
• Circumvent platform security
  
• Abuse API access
  
• Automate attacks against BE MOGUL® services
  

Violation may result in immediate termination of access without refund.

24. SUBSCRIPTIONS, BILLING & AUTO-RENEWAL

Certain BE MOGUL® products operate as recurring subscriptions.
By subscribing, you authorize recurring billing using your selected payment method until canceled.
Failure of payment may result in:

• Suspension of access
  
• Removal from communities
  
• Loss of premium features
  
• Loss of software access
  
• Suspension of affiliate privileges
  
• Permanent account deletion where applicable
  

Tier 3 Studio members whose SaaS subscription remains unpaid for three (3) consecutive months acknowledge that their Studio account, applications, automations, databases, files, branding, connected services, and stored content may be permanently deleted without further notice.
BE MOGUL® is not responsible for recovering deleted information after account termination.

25. PRIVACYBE MOGUL® respects your privacy.
Information collected may include:

• Purchase history
  
• Login information
  
• Usage analytics
  
• Community participation
  
• Customer support communications
  

Information is used solely for operating, improving, supporting, securing, and marketing BE MOGUL® products and services, subject to applicable law.
BE MOGUL® does not sell personal information to third parties.

Information may be shared with trusted service providers solely for payment processing, email delivery, hosting, analytics, customer support, fraud prevention, or legal compliance.

26. EARNINGS DISCLAIMERBE MOGUL® provides educational resources, software, coaching, automation tools, and business systems.
We do not guarantee:

• Income
  
• Sales
  
• Business funding
  
• Grants
  
• Government contracts
  
• Followers
  
• Clients
  
• Brand growth
  
• Social media success
  
• Affiliate earnings
  
• Business profitability
  

Examples, testimonials, demonstrations, and case studies represent individual experiences and should not be interpreted as guarantees of future results.
Success depends on many factors beyond our control, including experience, effort, consistency, market conditions, and business decisions.

27. LICENSE TO USE SOFTWARE

Unless otherwise stated in writing, every purchase grants a limited, non-exclusive, non-transferable, revocable license to use BE MOGUL® software, AI systems, educational materials, and digital products for the purchaser's own authorized business or personal use.
No ownership rights are transferred.

Users may not sublicense, lease, rent, sell, assign, or redistribute access without written authorization.

28. FUTURE PRODUCTS

These Terms automatically apply to all future BE MOGUL® products, including software, AI systems, mobile applications, websites, communities, digital downloads, memberships, coaching programs, subscriptions, licensing programs, events, physical products, and technologies unless separate terms are expressly provided.

Continued use of future products constitutes acceptance of these Terms.

29. SEVERABILITY

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

30. ENTIRE AGREEMENT

These Terms and Conditions, together with any applicable Privacy Policy, Refund Policy, Licensing Agreement, or written purchase agreement, constitute the entire agreement between BE MOGUL® and the user regarding the use of its products and services.

Any prior oral or written representations not expressly incorporated herein are superseded by this Agreement.
